Download The International Law Of Migrant Smuggling book, Whether forced into relocation by fear of persecution, civil war, or humanitarian crisis, or pulled toward the prospect of better economic opportunities, more people are on the move than ever before. Opportunities for lawful entry into preferred destinations are decreasing rapidly, creating demand that is increasingly being met by migrant smugglers. This companion volume to the award-winning The International Law of Human Trafficking, presents the first-ever comprehensive, in-depth analysis into the subject. The authors call on their experience of working with the UN to chart the development of new international laws and to link these specialist rules to other relevant areas of international law, including law of the sea, human rights law, and international refugee law. Through this analysis, the authors explain the major legal obligations of States with respect to migrant smuggling, including those related to criminalization, interdiction and rescue at sea, protection, prevention, detention, and return.

Between Criminalization And Protection

by Vincenzo Militello, Between Criminalization And Protection Books available in PDF, EPUB, Mobi Format. Download Between Criminalization And Protection book, This volume is devoted to the dark side of human mobility, that is migrant smuggling, and, linked with it, human trafficking. Both subjects will be mainly treated from an Italian perspective; however, due to their having a generally transnational character, the analysis will necessarily require that international and supranational actions/measures also be taken into account. Moreover, the legal perspective will be supplemented by the phenomenological/criminological one, through which the authors try to provide the work with a realistic dimension aimed at grasping the practical aspects of both migrant smuggling and human trafficking emerging from the different ways in which such crimes are de facto committed.

Criminal Responsibility Of Migrant Smugglers In International Criminal Law

by Florence Baumann, Criminal Responsibility Of Migrant Smugglers In International Criminal Law Books available in PDF, EPUB, Mobi Format. Download Criminal Responsibility Of Migrant Smugglers In International Criminal Law book, The thesis analyses the individual criminal responsibility of migrant smugglers in international law. The purpose of this thesis is to analyse under which provisions migrant smugglers can be held accountable. The first section of the thesis explains the phenomenon of migrant smuggling and delimitates it from other related phenomena. In order to legally analyse the criminal responsibility of migrant smugglers, the methods of three migrant smugglers are presented. The Statute of the International Criminal Court provides the definition and criminalization of the most serious crimes. The legal analysis of the smugglers concluded that their actions do not constitute one of those crimes. However, there is a more specific international instrument: the United Nations Protocol against the Smuggling of Migrants by Land, Sea and Air. The legal analysis of the three smugglers' methods established that, while all three committed the crime of migrant smuggling, there are some issues within the Protocol, such as the definition of the act itself, that can make it difficult to prosecute smugglers.
